Defendant served in the Army, including a tour in Iraq where she earned 3 separate service medals, and then served in the Air Force Reserves, receiving an honorable discharge in 2011. However, a harassment conviction meant that she could not reenlist. Judge granted the Clayton motion and dismissed the case. "Dismissal of this action, which arose from a single aberrant act in an otherwise exemplary life, would not negatively impact the confidence of the public in the justice system."
