Plaintiff alleges that Defendant denied Plaintiff housing and willfully or, alternatively, negligently failed to advise her that its denial of her application was based on information from a consumer report. Later, Defendant refused to provide Plaintiff with any specifics as to the consumer report or its source and failed to inform her of her right to inspect and receive copies of the consumer report, all in violation of the federal Fair Credit Reporting Act and New York State's Fair Credit Reporting Act, thus impeding Plaintiff's ability to discuss the rejection of her application, even though Defendant's denial letter to her invited Plaintiff to do so.
