In this bawdy house case, the respondents demanded a trial by jury, and the petitioner moved to strike that demand, on the basis of a waiver included in the lease. The court found in favor of the respondents, affirming the right to a jury trial on the grounds that the right is so fundamental that courts must indulge every reasonable presumption against waiver.
