Motion to Renew and Reargue Previous Application for Certificate of Relief from Disabilities Pursuant to CPLR 2221 (Monroe County Legal Assistance Center)

  • Organization: Monroe County Legal Assistance Center LSC funded
  • Author: Jason Hoge
  • Document Type: Pleadings (other than briefs)
  • Date Created: Tuesday, October 24, 2006
  • Submitted: Friday, November 17, 2006
  • Attachment(s): DOC

Motion to renew and reargue previous application for a CRD denied by Monroe County Court on the basis that applicant owes outstanding restitution debt.

The motion argues that the application should be reconsidered because the original application was submitted by the petitioner without assistance of counsel, and did not contain essential facts that were unavailable to the petitioner at the time the petition was made.

The motion argues that the petitioner has demonstrated rehabilitation and is in process of duly repaying her restitution debt, and asks that the Court issue a temporary Certificate of Relief from Disabilities on the condition that payments continue, so that the petitioner may obtain her Registered Nurse License.
