Real Property Law Section 231(1) renders void a lease or an agreement for occupancy of any premises that is used in whole or in part for any illegal trade, manufacture, or other business. The statute only renders the lease void and it does not contain any provisions authorizing eviction proceedings. In eviction proceedings the statute is always used with RPAPL Section 711 (5) or 715 (1).
