Model Complaint filed in Monroe County Supreme Court alleging violations of Article 23A of the Corrections Law.

(1) The Defendant unfairly discriminated against plaintiff and violated the provisions of Correction Law § 752 by denying plaintiff employment as an LPN by reason of plaintiff's having been convicted of one or more criminal offenses.

(2) Defendant violated Correction Law § 753 by failing to consider the required factors when refusing to hire plaintiff as an LPN due to her prior criminal record.
