This memorandum reviews state laws governing an employer's liability in the situation where an individual with a criminal record, hired by and working for the employer, commits a criminal act that causes injury to a third party. Whether the injured party is a customer of the employer or a stranger, the employer may be liable for the employee's criminal acts, or omissions.
