Attached is a decision by Judge Badillo disqualifying the DA from appearing and conducting trial in a drug holdover commenced by the landlord. It is the only Queens County decision disqualifying the DA and contradicts most of the dicta in Rochdale Village. Badillo allowed the DA to sit at the landlord's table during trial, however, and the decision does not address the appearance of impropriety issue raised by that.
